A viral message circulating on social media (especially WhatsApp and Facebook) claims that the Supreme Court has ruled on the popular religious rights case between Shafic Osman (plaintiff) and the Board of Governors of Wesley Girls’ Senior High School, and others.
According to the message as shared on WhatsApp, the Apex Court presided over by Justice Gabriel Pwamang had ordered the school to allow Muslim students to wear the hijab, fast, and pray, provided it doesn’t disrupt general school discipline.
The message, which had the “forwarded many times” label read in part: “While mission schools have a right to preserve their ethos, this autonomy cannot violate the Constitution…. Under Articles 17 and 28, no child should be forced to choose between their education and their faith…Building on the Achimota School (Rastafarian hair) precedent, the court found that the school’s restrictions were not “necessary or proportionate” to maintaining school discipline.”
The viral message also adds that the Court ruled that the restrictive policies were unconstitutional, null, and void before giving three orders on Immediate Accommodation (of rights), Cessation of Compulsion and National Reform.

To verify the claim, GhanaFact conducted a Google search and found that no credible media outlet had reported on the purported ruling, although the case dominated media discussions when it was sent to court. See published stories on the case here, here, here, and here.
GhanaFact also noted that the petitioner in the case, Shafic Osman, in a Facebook post, debunked the claim, saying, “ignore the news please. don’t know who sat down to draft that fake ruling.”

It is worth noting that the Supreme Court has yet to rule on the case.
